“在澳洲,你的導師性騷擾你該怎麼辦?” 我說:“吉他,吉死他。”  
 
2018年,澳洲人權協會(Australia Humanright commision)發佈一個調查,在澳洲的39所大學裡,有五分之一(21%)的學生都曾經遇到性騷擾。超過半數的人都認識加害者,94%的人都選擇沉默。
或許這是一個冷門話題,但是我想說的是,不要因為你是一個國際學生覺得自己的英文不夠好或是對當地法律,文化有有限的認識,而失去你應有權利。這篇的分享是想告訴大家即使是國際學生也有很多資源,而且是免費的。不止是Sexual violence, 其他國際學生常碰到的學校行政不公平, 很多校內外內免費的咨商資源,都是國際學生可以使用的!
 
分享這個經驗是我相信,每個人都有權利對要傷害她的事說不,也有力量去幫助其它的人。
 
 
首先,當你意識到你可能遭遇到這件事,先冷靜下來。檢視一下有多少證據,包含所有的圖片,錄音檔,驗傷報告,咨商記錄。
接下來拿出筆電或是一張紙,儘你最大的努力,把時間,地點,發生的事件列出來,做成一個清楚的時間表。
 
然後,就是你做選擇的時候:
你可以選擇報告給學校或是再進一步採取法律行動。

有點像台灣學校內的性平委員會。基本上是跟學校領錢的機構XDDDDD,職責是調停校內歧視,性騷擾的事件。個人說這真的只是一個選項,但不是必要的選項。試用過的心得是:這根本就是法治之外的平行時空。
 
但如果你覺得你不至於構成到犯罪的話,你的例子也可以成為他們的備案。
基本上你要做出一個 Event timeline, 基本上就是讓人顯而易見到底發生了什麼事 還有所有你可以作為證據的物件。然後你有幾個選項可以做:
 
第一.你可以只是做statement,告訴他們到底發生什麼事。然後什麼也不做,讓你的檔案成為下一個來report 的備案這樣。
 
第二. 他們也可以提出匿名舉報的選項,在我的case裏,我第一次不得不做的選擇就是匿名舉報,他們接下來會跟你說,因為匿名舉報的關係,我們能透露的資料有限,所以你的complain不成功。
 
第三. 正式舉報。在我的case裏,這個正式complain會有一個internal invesgation,由商學院的高層主管或是導師的supervisior來決策(恩?不是由第三方來主持)然後你還要被要求簽一份神秘的confidential aggrement,我會說神秘是因為他們從來不給我看這份文件,(是說這份文件有神秘到跟百慕達三角洲一樣都看不見......)說我只能當面簽(????????)
所以到最後我跟他寫email 說:恩,老娘想去報警了(沒那麼直接啦,我很謙虛請教有沒有其他校外的資源呢。),
 
然後我就突然不用簽了???????

個人真心建議:與他們交涉的過程跟決策最好是都能在是用email。一方面也是確定沒有因為語言關係而有不必要的誤會,一方面也是能夠確認流程。
我後來在聽到我第一次不得已而只能照他們做的匿名舉報失敗後,我都很懶的跟他們會面,後來除非必要或是他們要求,我基本上都是用email跟他們聯絡感情(negotiation
 
Student Equity, the depart take to charge the discrimination and sexual violence in the university.
It’s optional. Basically, they won’t help you anything related to the legal process, even though I consider sexual harassment and assault as a crime. In my case, I was asked to make a formal complaint and pushed to sign a confidential agreement.  The formal complaint was managed by the perpetrator’s supervisor (not the third party) and the consent of confidential agreement means that you agree with the result of the internal investigation. For me, it is like a Parallel universe out of the law. if you don’t mind to give in your right and wanna your experience to become a dusty file in the box, then it’s an option to you.
